Beam Suntory Pays $19.6M, Winning No Credit From DOJ for Previous SEC Settlement

More than two years after settling with the SEC, distilled beverage maker Beam Suntory Inc., agreed to pay almost $19.6 million as a criminal penalty to resolve criminal FCPA allegations related to its business in India with the DOJ. Beam not only ignored red flags, the DOJ said, but repeatedly disregarded suggestions to make improvements to its compliance program. We look at why the company did not receive credit for the earlier $8‑million settlement with the SEC and only received partial credit for its cooperation.
