Lessons from Frederic Cilins’ Guilty Plea to Obstruction of a Criminal FCPA Probe

Frederic Cilins, a French national with ties to Guernsey-based metal, mining and energy company BSG Resources, has pled guilty to obstructing a federal criminal investigation into allegations of bribes paid in Guinea in exchange for valuable mining rights in 2008.  Cilins initially pled not guilty to a five-count indictment following his arrest at a Florida airport in April 2013.  Edward Kang, a partner at Alston & Bird LLP and former prosecutor, shared his views with the Anti-Corruption Report about the case and what companies can learn from it.  See also “A Guilty Plea and Two Flight Risks in PetroTiger Columbian Bribery Case” (Jan. 22, 2014); “Five Lessons from 2013 FCPA Enforcement: Transaction Monitoring, International Cooperation, Documenting Hiring Decisions, Risk Assessments and Individual Prosecutions” (Nov. 6, 2013).
